1. Acceptance of Terms
By accessing or using WaffleIQ ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
WaffleIQ provides an AI-powered people and business search platform that helps go-to-market teams discover, enrich, and qualify leads. Features include natural language search, ICP scoring, data enrichment, and export tools.
3. Eligibility
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization. The Service is intended for business use only.
4. Account Responsibilities
You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. WaffleIQ is not liable for losses arising from unauthorized use of your account.
5. Acceptable Use
You may not use the Service to scrape, harvest, or aggregate data for resale; send unsolicited communications; violate applicable privacy laws (including GDPR, CCPA); or engage in any fraudulent, deceptive, or illegal activity.
6. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to our data practices as described therein.
7. Intellectual Property
WaffleIQ and its licensors retain all rights to the Service, including all software, designs, and content. You retain ownership of any data you upload. You grant WaffleIQ a limited license to process your data to provide the Service.
8. Subscription and Billing
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.
9. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time; access continues until the end of the current billing period.
10. Limitation of Liability
To the maximum extent permitted by law, WaffleIQ's liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved by binding arbitration in accordance with the AAA Commercial Arbitration Rules.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We'll notify you of material changes by email or in-app notice.
